Terms of Service

These Terms of Service (“Terms”) govern your use of the Qtrackr platform operated by Eventim Global Events GmbH (“we”, “us”, “our”), a company registered in Switzerland. By accessing or using qtrackr.io and any associated subdomains (“the Service”), you agree to these Terms.

If you don't agree, please don't use the Service. (We'll be sad, but we'll understand.)

1. Definitions

  • “Client” means an event organiser or business that uses Qtrackr to create and manage ticket queues
  • “Customer” means an individual who signs up for an event queue through the Service
  • “Admin User” means anyone with administrative access to the Qtrackr dashboard
  • “Content” means any data, text, images, or materials uploaded to or generated by the Service

2. The Service

Qtrackr is a queue management and ticket distribution platform for live events. We provide tools for event organisers to manage ticket queues, distribute tickets (via promo codes, native barcodes, timed reservations, or Eventim Secure Links), and communicate with customers via email and SMS.

We are a platform provider. We do not organise events, sell tickets, or act as a ticket agent. The event organiser (Client) is solely responsible for the event itself, ticket availability, pricing, and fulfilment.

3. Account registration

For Clients and Admin Users

To use the admin features of Qtrackr, you need an account. You agree to provide accurate information, keep your credentials secure, and notify us promptly if you suspect unauthorised access. You're responsible for all activity under your account.

For Customers

Customers don't need a traditional account. You verify your identity via a one-time email code (OTP) each time you access your queue status. By signing up for a queue, you agree to these Terms and our Privacy Policy.

4. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorised access to any part of the Service
  • Scrape, crawl, or use automated tools to extract data from the Service
  • Share, forward, or redistribute secure purchase links intended for your use only
  • Sign up for a queue using false information or on behalf of others without their consent
  • Interfere with or disrupt the Service or its infrastructure
  • Use the Service to send spam, phishing, or unsolicited messages
  • Attempt to circumvent geofencing restrictions or other access controls

We reserve the right to suspend or terminate access for anyone who violates these rules. Don't make us do that.

5. Client responsibilities

If you're a Client using Qtrackr to manage events, you agree that:

  • You are solely responsible for the events you create and the tickets you distribute
  • You will only use customer data collected through Qtrackr for purposes related to your event
  • You will comply with all applicable data protection laws (including GDPR and Swiss FADP) when processing customer data
  • You are responsible for the content of your custom email and SMS templates
  • You will configure SMS (Twilio) at your own cost and in compliance with applicable telecom regulations
  • You will not use the platform to facilitate fraud, scalping, or deceptive practices

6. Intellectual property

The Service, including its design, code, branding, and documentation, is owned by Eventim Global Events GmbH and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

Content you upload (logos, branding assets, template text) remains yours. By uploading it, you grant us a limited licence to use it solely for the purpose of providing the Service to you.

7. Data and privacy

Our handling of personal data is governed by our Privacy Policy. By using the Service, you acknowledge and agree to the practices described there.

Where a Client acts as a data controller and we process data on their behalf, we act as a data processor. Clients requiring a Data Processing Agreement (DPA) can request one by contacting us.

8. Service availability

We aim to keep Qtrackr available 24/7, but we can't guarantee uninterrupted service. Downtime may occur for maintenance, updates, or circumstances beyond our control. We'll do our best to give advance notice for planned maintenance.

We are not liable for any losses arising from Service downtime, including missed ticket assignments or delayed notifications.

9. Payment and billing

Plans and pricing

Qtrackr offers four subscription tiers: Basic, Advanced, Expert, and Enterprise. Current pricing is published on our pricing page. We may update pricing from time to time; existing subscribers will be given at least 30 days' notice before any price increase takes effect on their next renewal.

Merchant of Record

All payments are processed by Paddle.com Market Limited(“Paddle”), who acts as our Merchant of Record. When you subscribe, you enter into a purchase agreement with Paddle — not directly with us. Paddle handles payment processing, invoicing, sales tax, VAT, and applicable transaction fees on our behalf. Paddle's terms apply to the payment transaction itself: paddle.com/legal/terms.

Billing cycle

Subscriptions are billed either monthly or annually, depending on the plan you choose. Annual plans are charged upfront for the full year at a discounted per-month rate. All prices are shown inclusive of the billing period but exclusive of applicable taxes, which Paddle calculates and adds at checkout based on your location.

Currency

You may choose to pay in USD, EUR, or GBP. The currency you select at checkout applies for the duration of your subscription. Currency changes take effect at the start of your next billing cycle.

Upgrades and downgrades

You may upgrade your plan at any time. Upgrades take effect immediately and the price difference is prorated for the remainder of your current billing period. Downgrades take effect at the start of your next billing cycle — you retain access to higher-tier features until then.

Cancellation and refunds

You may cancel your subscription at any time from your account settings or by contacting us. Cancellation takes effect at the end of your current billing period — you keep access until then. For full details on refund eligibility for monthly and annual plans, see our Refund Policy.

Failed payments

If a payment fails, Paddle will retry according to their standard dunning schedule. If payment remains unsuccessful after multiple attempts, your subscription may be suspended or downgraded. We'll notify you before any access changes take effect.

Free tier and trials

We may offer free trials or promotional periods at our discretion. Unless you actively subscribe to a paid plan before the trial ends, no payment will be taken. We'll always tell you before a trial converts to a paid subscription.

Customers (queue sign-ups)

Customers who sign up for event queues are not charged by Qtrackr. Any ticket prices or fees are set by the event organiser and handled outside our platform.

10. Limitation of liability

To the maximum extent permitted by Swiss law:

  • The Service is provided “as is” without warranties of any kind, express or implied
  • We are not liable for any indirect, incidental, special, or consequential damages
  • Our total liability to you is limited to the fees you've paid us in the 12 months preceding the claim
  • We are not responsible for the actions, content, or policies of event organisers using the platform

Nothing in these Terms excludes liability for fraud, gross negligence, or anything that cannot be excluded under applicable law.

11. Termination

Clients: you may cancel your subscription at any time via your account settings or by contacting us. Cancellation takes effect at the end of your current billing period. We may terminate or suspend your access if you breach these Terms, with reasonable notice where practicable. If we terminate your account for breach, no refund is due for the remaining billing period.

Customers: you can request deletion of your queue data at any time by contacting us at hello@qtrackr.io.

On termination, we will delete or anonymise your data in accordance with our Privacy Policy, unless we're required by law to retain it.

12. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll update the “Last updated” date and make reasonable efforts to notify affected users. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing law and disputes

These Terms are governed by the laws of Switzerland. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts at the registered seat of Eventim Global Events GmbH in Switzerland.

14. Miscellaneous

  • If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full effect
  • Our failure to enforce a right doesn't mean we've waived it
  • These Terms, together with the Privacy Policy and any service agreement, constitute the entire agreement between you and us
